On the above date and time officers of the Sand Creek Division were dispatched to a reported shooting. Upon arriving on scene, officers located a male with an apparent gunshot wound to the leg. The male was transported to the hospital for treatment of his injuries, which are not considered life threatening at this time. Investigation revealed the male was shot outside of a business by an unknown male suspect. The investigation into the incident is continuing at this time.

On March 7, 2017, the Colorado Springs Police Department’s Violent Crimes Section, Robbery Unit, arrested a second juvenile male, 16 years of age, for his association with a series of robberies identified earlier today. The juvenile suspect, charged with Aggravated Robbery, is currently in custody for Sexual Assault.

Today’s arrest was made for the following local robberies:

Beginning in January of 2017, the Colorado Springs Police Department’s (CSPD) Violent Crimes Section, Robbery Unit, investigated a series of business robberies which occurred at various locations throughout the city. During these robberies, several masked suspects armed with weapons would enter the business and flee with cash and other items. During the commission of a robbery on February 15, 2017, at 3381 North Academy Boulevard, Empire Wine and Liquor, Mr. Donat Herr was tragically shot and killed. Mr. Herr was an owner of the store. In their search to identify the suspects in this pattern, CSPD Robbery Unit and Homicide Unit detectives worked closely with other local investigative entities. Assisting agencies include Metro Vice, Narcotics, and Intelligence and the local field offices of the FBI, specifically the Safe Street Task Force and the Bureau of Alcohol, Tobacco, and Firearms (ATF.)

On the morning of March 2, 2017, the CSPD Tactical Enforcement Unit (TEU) and the El Paso County Sheriff’s Office Special Weapons and Tactics Team (SWAT) executed several search warrants related to this investigation. The focus of these warrants was to collect evidence and to arrest suspects identified through the investigation. On this date, investigators arrested 19 year old Dustin Cole Logan, 18 year old Phinehas Tyree Daniels, and a third juvenile male, 13 years of age. These arrests were made for their connection to the following local robberies:

On March 6, 2017, the CSPD Homicide Unit served an additional arrest warrant on 18 year old Phinehas Tyree Daniels and the aforementioned juvenile male, 13 years of age. These warrants were for charges to include First Degree Murder for the death of Mr. Herr. Both suspects remain in custody. Detectives are continuing their investigation and additional arrests related to the robbery pattern are anticipated.

On 03/06/17 at approximately 0048 hours, CSPD Officers were dispatched to the 4300 block of Centerville Drive reference a traffic accident where a vehicle had been driven into a house and the male driver had reportedly fled the scene. Upon the officers’ arrival the driver had already fled the scene, but the residents of the home were contacted and not injured. Further investigation showed the pickup truck was traveling west in the 4300 block of Centerville Road when it struck a parked vehicle, veered of the roadway and traveled into the side of a house striking two vehicles that were parked inside the garage. The driver was later located and taken into custody in the parking lot of a convenient store located at the intersection of Peterson Road and N. Carefree Circle. The driver was charged with several traffic related violations to include Driving Under the Influence. Alcohol and speed are believed to be contributing factors to the traffic accident. The home sustained significant damage as a result of the traffic accident.

***UPDATE*** As of 2310 hours, the intersection has been reopened, and all lanes of traffic are open for travel.

On 03/04/17 Gold Hill officers were dispatched to the intersection of E. Pikes Peak Ave and Institute St for a traffic accident involving a motorcycle. Early investigation revealed that an SUV was travelling west bound on E. Pikes Peak Ave. The SUV began making a left turn onto Institute St in front of the motorcycle that was travelling east bound on E. Pikes Peak Ave. The motorcycle collided with the passenger side of the SUV causing extreme damage to the SUV and motorcycle. The driver of the motorcycle was not wearing a helmet and was transported to Memorial Hospital with life threatening injuries. The driver of the SUV only suffered minor injuries and remained on scene. Alcohol and drugs do not appear to be involved.

**The intersection of Pikes Peak and Institute will be closed down for several hours while the investigation continues.**

On Saturday, March 04, 2017 Patrol Officers from the Falcon Division were dispatched to the 5200 block of N. Academy Blvd. to reports of a male in a business parking lot pointing a firearm at unsuspecting citizens. Further reports indicated the male had entered one of the retail stores prior to Police arrival. When Officers arrived on scene, they did find the male suspect inside a retail store, and he was detained without incident. The male was found to be in possession of a simulated firearm. The male suspect, identified as 32 year old Tyler Fengler, was arrested for Felony Menacing, Impersonating a Peace Officer, and Unlawfully Concealing a Weapon. There were no injuries reported and no shots were fired during this occurrence.

On March 4th, 2017, at approximately 6:30AM, officers from the Gold Hill Division responded to a fast food restaurant in the 1700 block of E. Platte Avenue on a reported attempted robbery. A lone man had ordered a lot of food and tried to pay with counterfeit money. When denied the man created a disturbance by demanding his food, threatening to kill people, pushing people and breaking cash registers. The man left the store before officers arrived.

As officers came into the area they located the suspect a block away. The man wanted to fight the officers and they were able to take him into custody after tasing him.

On 03-03-2017 Sand Creek Officers Rutter and Colburn went to 2010 Carmel Dr. to try and contact a Felony Domestic Violence suspect. Upon arrival they found the victim of the Domestic Violence assault present. The victim allowed officers into her residence and told them the suspect was hiding in an open bedroom. Officers made several announcements for the suspect to exit the room. The suspect did not follow orders.
Officers requested the assistance of a police canine. Officer Sheldon and Canine Dax responded. Officer Sheldon gave several warnings for the suspect to come out of the apartment or the canine would be used. The suspect did not follow Officer Sheldon’s orders. Canine Dax was released and found the suspect hiding in a bedroom. Canine Dax made contact with the suspect allowing Officers to safely enter the room and take the suspect into custody. The suspect was transported to the hospital. He will be booked into CJC for felony Domestic Violence Assault after treatment.

The Colorado Springs Police Department is asking for the public’s assistance in locating a fugitive named Holly Janette Dalton. The Colorado Springs Police Departments Financial Crimes Unit has obtained a warrant for the arrest of Ms. Dalton a 44 year old white female 5’4”, 115 pounds, blond hair, brown eyes. Ms. Dalton is wanted for theft. Ms. Dalton owned a property management/ reality firm named Premiere Properties, and Encore Properties LLC, located at 1295 Kelly Johnson Blvd.
Ms. Dalton is allegedly responsible for taking the damage deposits paid by tenants and held in escrow, for her clients and using the monies for her own benefit. In the summer of 2016 Ms. Dalton also took the monthly rental receipts and did not forward them to the landlords as well. In taking the rental receipts Ms. Dalton would roll the payments in a lapping scheme where she would pay some landlords keeping the receipts from others for several months then pay the missed payments using the monies meant for other landlords. Ms. Dalton was not able to keep the missing rental payments current and as a result would fall behind causing the lapping scheme to fall apart.
In this case there were 15 victim landlords and over 27 victim tenants. The total amount of the theft is $95,937.00.

On 03/02/2017 at approximately 0054 hours, the Colorado Springs Police Department received a call for service reference a Robbery with a weapon at a business located in the 4600 block of Austin Bluffs Pkwy. Upon the officers’ arrival, the suspects had fled the business. The suspects were described as males wearing dark clothing. Officers searched the area but were unable to locate the suspects. No injuries were reported and no arrests have been made. The investigation is ongoing.
